Legal ownership has to be provided to the commercial registry when registering a company (GF 2016: 23-24). In 2019, the Global Forum confirms: "Within a month of its incorporation by deed, all companies must deposit a copy of their constitutional deed to the Secretariat of the Mercantile Register" (GF 2019: 29). While ownership information is not contained in the deed (ibid.), "[a]ll companies are obliged to also deposit a document detailing the subscribed capital as well as a list of all the shareholders including their names, address, and the number of shares they hold (art. 42, Commercial Code)" (GF 2019: 30). Also, following registration with the commercial registry (Mercantile Register), "all types of companies must proceed to register for tax purposes in the National Registry of Taxpayers (RNC, Registro Nacional de Contribuyentes), maintained by the DGII (Art. 50 Tax Code)" (GF 2019: 31). The Global Form confirms that all companies operating in Free Trade Zones must also comply with ownership reporting obligations, regardless of their tax liability (GF 2019: 32).
