The Global Forum reports that registration of a trust (both domestic and foreign) is optional in Anguilla : "In the case of trusts, registration in the Register of Trusts is not mandatory in Anguilla. It is at the discretion of the trust company. [...] Anguillan law does not require the registration of trusts (although it is optional) " (GF 2014: 43-44). Article 66(3) of the Trusts Act determines as follows: "The settlor or a trustee of a trust may apply but, subject to the terms of the trust, shall not be obliged to apply to the Registrar to enter the trust on the Register". This was confirmed at the website of the Anguilla Financial Services Commission: "The underlying legislation regarding trusts is the Trusts Act 1994, which seeks to modernize trust law with respect to security, confidentiality and flexibility, while preserving best features of common law trust interpretation. The Trusts Act allows for the optional registration of trusts" (fsc.org.ai/trust.php).
